IEEPA 退税下一阶段怎么走 · 中英对照 · Phase 1 操作要点

已于 2026 年 4 月 20 日上线 CAPE 系统，正式处理 IEEPA 关税退款。Phase 1 大约覆盖 63%
的报关单——只接受未清算和清算后 80 天内两类入境。其它情况要等后续阶段。本文按 Holland & Knight 律所 4 月 22
日简报整理中英对照要点。 

过去两周后台被"我那笔税到底能不能走 CAPE"刷屏。上一篇我们写过 IEEPA
退款的政策背景和谁能退（UPS/CBP 视角），这一篇换一个角度——从 CBP 实际操作流程出发，把 CAPE Phase 1
的资格、流程、时间、坑位用中英两套语言对齐讲清楚。

美国律所 Holland & Knight 4 月 22 日刚出了一份非常完整的实操简报。下面按它的结构走一遍，每段先给英文要点，再给中文对照。有原文 PDF 链接放在文末，给客户或律师沟通时可以直接发过去。

01三个核心要点 / Highlights

CBP launched Phase 1 of the Consolidated Administration and Processing
of Entries (CAPE) tool on April 20, 2026, to process IEEPA duty refunds.

中文：美国海关（CBP）于
2026 年 4 月 20 日上线了 CAPE 系统第一阶段，正式启动 IEEPA 关税退款的处理。CAPE
全称是"入境清单的合并管理与处理"（Consolidated Administration and Processing of
Entries），是 ACE 系统下新增的退款专用模块。

EN: Phase 1 is expected to
cover about 63% of affected entries, generally limited to unliquidated
entries and those liquidated within the prior 80 days.

中文：Phase 1 预计能覆盖约 63% 的相关报关单，主要限定在两类：① 尚未 liquidation（清算）的报关单；② liquidation 完成但还在过去 80 天之内的报关单。其它更复杂的情况要等后续阶段。

EN: Importers should act now to confirm ACE access, register ACH details, and prepare entry data to timely secure refunds.

中文：进口商需要尽快做三件事：确认 ACE 门户账号能登、登记 ACH 银行账号、整理符合条件的报关单数据，才能在窗口期内拿到退款。

02CAPE 是什么 / What is CAPE

EN:
CAPE is a new functionality within the ACE platform. Instead of
processing refunds entry by entry, CAPE lets the importer of record
(IOR) or licensed customs broker submit a single "CAPE Declaration"
covering thousands of entries. CBP then recalculates duties, liquidates
or reliquidates as appropriate, and issues one consolidated refund with
interest.

中文：CAPE 不是独立平台，而是 ACE
系统下新增的一个模块。它解决的是"量"的问题——如果按每张报关单单独退，CBP 处理不过来。所以允许
IOR（进口商）或者持牌报关行一次性提交一份"CAPE 申报"，覆盖成千上万张报关单。CBP 后台批量重新计算关税、重新 liquidate /
reliquidate，然后合并成一笔带利息的退款一次性退给你。

背景：这次退款源自两个司法判决——Atmus
Filtration v. United States 和 Euro Nations Florida Inc. v. United
States。法院命令 CBP 必须退还依据 IEEPA 征收的全部关税。Atmus 案目前已撤销，但 Euro Nations
案的判决继续有效。 

03Phase 1 资格 / Eligibility

把 Phase 1 拆成三档：能直接退、能提交但暂不处理、不接受。一张表说清楚——

翻译成人话：CBP 后续会处理"已 final 的旧报关单"，但没给时间表。换句话说——liquidation 超过 80 天的那批货，Phase 1 不会管，要继续等。 

04四步流程 / Process Stages

① 提交与验证 / Submission and Validation

EN:
The original filing IOR or broker submits a CAPE Declaration through
the ACE portal. Download the CAPE upload template, fill in the entry
numbers, save as CSV, certify legal authority, and upload. Each CAPE
Declaration is capped at 9,999 entries, but you can submit multiple
declarations.

中文：由原始报关时的 IOR 或者报关行登入 ACE 门户。先下载 CAPE 模板，把报关单号填进去，存成 CSV 格式，勾选"我有合法授权"的声明，然后上传。每份 CAPE 申报最多 9,999 张报关单，超了就再开一份提交。

② 批量处理 / Mass Processing

EN:
CBP removes the IEEPA tariff lines from each entry, recalculates as if
IEEPA had never applied, and adds interest under 19 U.S.C. §1505(c) from
the original payment date through liquidation / reliquidation. For Q1
2026, overpayment interest is 7% (non-corporate) and 6% (corporate).

中文：CBP
从每张报关单里把 IEEPA 关税那一行抽掉，按"如果当初没征过 IEEPA 关税"重新算一遍。差额部分按 19 U.S.C.
§1505(c) 加利息，从原始缴税日起算到 liquidation / reliquidation 日。2026 年第一季度，超额缴税的利率是
7%（非公司）或 6%（公司）——这部分国内做 FBA / DDP 的同行注意，有利息可以一起拿回来。

③ Liquidation / Reliquidation

EN:
CBP estimates unliquidated entries will liquidate ~45 days after CAPE
acceptance; entries already liquidated but not final get reliquidated
the next business day. Suspended / extended / under-review entries and
warehouse entries liquidate in the normal course.

中文：未 liquidation
的，CBP 受理后 约 45 天完成 liquidation；已 liquidation 但还没"最终"的，下一个工作日就完成
reliquidation。处于暂停 / 延期 / 复核状态的，按正常节奏 liquidation。

④ 退款发放 / Refund Issuance

EN:
CBP issues one consolidated lump-sum refund per IOR (or per Form 4811
designee) via ACH electronic transfer. Expected timing: 60–90 days after
CAPE acceptance. Acceptance itself usually takes ~10 days, so total
= ~70–100 days from submission.

中文：CBP 按 IOR（或 Form 4811 指定方）一次性合并一笔退给你，走 ACH 电子转账，不是支票。预计 受理后 60–90 天到账。"受理"这一步本身大约 10 天，所以从提交到银行卡到账，总周期 70–100 天左右。

05四个关键操作坑 / Strategic Considerations

① Protest（抗辩）

EN:
If a protest was filed solely to recover IEEPA duties, it can be
withdrawn within 80 days of liquidation and the entry resubmitted via
CAPE. But if the protest covers broader issues, think twice — Phase 1
won't accept entries with an active protest.

中文：如果当初提的
protest 就是为了拿回 IEEPA 关税，可以在 liquidation 后 80 天内撤回，然后丢进 CAPE 走快通道。但如果
protest 里还包含其它争议事项，撤了就把别的诉求一起撤了——这种情况要权衡：继续走 protest 流程，还是让位给 CAPE。Phase
1 一旦发现报关单有未决 protest，直接拒收。

② Post Summary Correction（事后摘要修改，PSC）

EN:
PSCs cannot be used to request IEEPA refunds. Any other unrelated PSC
fixes should be done before submitting the CAPE Declaration.

中文：PSC 不能用来申请 IEEPA 退款。如果你那张报关单本来也有其它信息要改（HTS 编码错、申报数量错），先把 PSC 改好再提交 CAPE，顺序不能反。

③ Drawback（退税）

EN: CBP recommends filing CAPE claims BEFORE drawback claims, to avoid conflicts or delays.

中文：如果同一票货既要走 CAPE 退税，又要走 drawback 退税，CAPE 在前、drawback 在后。反过来会冲突，整票卡住。

④ 第三方 / Refund Designation

EN:
Only the IOR or the filing broker can submit CAPE Declarations. Refunds
go to the party on record. Form 4811 can redirect where the refund is
sent, but does NOT transfer ownership of the refund. Third-party
recovery is a private matter between the parties.

中文：能提交 CAPE
申报的，只有 IOR 本人或者当初报关的 broker。退款也只发给登记在案的那一方。Form 4811
只能改"打到哪个账户"，不能改"钱是谁的"——所以中国货代如果实际承担了税金，但 IOR
是美国买家，钱依然先回到美国买家手里，要不要分给你、按什么比例分，是你俩私下的事，CBP 不管。

06建议立即去做的几件事 / Recommended Next Steps

① 确认 ACE 门户能登 / Confirm ACE Portal Access

让自己的团队或者合作的报关行确认 ACE 账号能登。CAPE 必须直接在 ACE 门户里提交，没账号就申请不了。登进去之后，找页面里新增的"CAPE"标签页。

② 在 CBP 登记 ACH 银行账号 / Register ACH Payment Details

ACE 账号里如果没填当前有效的 ACH 银行账号，CBP 会把退款扣住，直到你补完信息。建议现在就去检查一遍。

③ 准备并提交报关数据 / Prepare and Submit Entry Data

把所有付过 IEEPA 关税的报关单分两类整理：未 liquidation 的，liquidation 在过去 80 天之内的。导成 CSV。其它的暂时不用整。

④ 标记 final liquidation 的报关单 / Flag Finally Liquidated Entries

这批 Phase 1 不收，但要继续盯着——一是后续 CAPE 阶段可能会接，二是留意 protest 的截止日期，错过窗口就只能走 CIT（国际贸易法院）了。

⑤ 复核 protest 策略 / Review Protest Strategy

手里有 protest 的，要逐张判断：撤回走 CAPE 更快？还是保留 protest 兼顾其它争议？没标准答案，看具体内容。

⑥ 比对 Phase 1 排除清单 / Flag Exclusions

逐张检查报关单——有没有标 reconciliation？有没有走 drawback？有没有挂着 protest？任何一条命中，从 CAPE 提交清单里剔出去，否则整批被退回来。

07悬而未决的事 / Open Questions

EN:
Phase 1 leaves a large subset unresolved — most notably,
entries liquidated more than 80 days ago (before January 30, 2026).
On April 1, 2026, CIT Judge Richard Eaton noted that "no resolution has
been reached" for finally liquidated entries via CAPE, and reminded
importers of remedies under 19 U.S.C. §1514 (protests).

留了一大块没解决——尤其是 liquidation 超过 80 天（也就是 2026 年 1 月 30 日之前完成
liquidation）的那批报关单。2026 年 4 月 1 日，美国国际贸易法院（CIT）法官 Eaton 在裁定中明确说，对于"已最终
liquidation 的报关单走 CAPE reliquidate 这件事，目前没有任何结论"，并提醒进口商注意 19 U.S.C.
§1514（protest 程序）规定的救济路径。

EN: CBP says future CAPE phases will
cover these, but no timeline has been announced. Importers with
deadlines approaching should consider whether to file protests now (and
possibly withdraw later) — or file a protective action in the CIT,
mindful of the two-year statute of limitations.

中文：CBP 说后续阶段会处理这些
final liquidated 的报关单，但没给时间表。对于 protest 截止日期临近的进口商，要在两个选项里做判断：① 现在先把
protest 抗起来，将来 CAPE 开了再撤；② 直接在 CIT 提一个"保护性诉讼"（protective action）锁定权利——注意
CIT 的诉讼时效是 2 年。

08给货代同行的一句话总结

① CAPE 是 ACE 系统里新加的退款专用模块，不是独立平台。要走这条路必须先有 ACE 账号 + ACH 银行登记。

② Phase 1 大概率不解决你的老货——只接未 liquidation 和清算后 80 天以内的。再老的等后续阶段，CBP 没给时间表。

③ 钱只退给 IOR。Form 4811 只能改打款账户，不能改钱的归属。中国货代实际垫付了税金的，要不要拿回来、怎么分，是你和美国 IOR 之间的事。

④ 受理后 70–100 天到账，带利息（7% / 6%）。这个利率比放在美元账户里强多了，符合条件的尽早提交。

⑤ 如果客户问到，给个标准回复模板：

 "您好。关于
CAPE 退税：CBP 已于 4 月 20 日上线 CAPE Phase 1，处理 IEEPA 关税退款。只覆盖未清算和清算后 80
天内的报关单（约占总量 63%）；申请需通过 ACE 门户，由 IOR 或原始 broker 提交；退款只发给 IOR，预计 70–100
天到账，带利息。建议先确认 ACE 账号 + ACH 银行登记，再整理符合条件的报关单 CSV。具体以 CBP 公告为准。"
