亚马逊侵权求各路大神支招,感激不尽!!!

各位大神好,我在亚马逊上传某影视作品的周边产品的时候,brand name 很神经的填了该影视作品的名字,五分钟后收到亚马逊的侵权投诉邮件。这个影视作品的周边产品之前是跟卖,没有出现问题。后面打算自己建个list,结果上传填了brand name, 其他list 因为标题涉及到这个影视作品名字也被投诉侵权了。

以下是亚马逊的回复以及我的申诉:

Hello,

You currently may not sell on Amazon.com because you are offering items that may infringe intellectual property rights . Examples of these items are at the end of this email.

Funds will not be transferred to you but will stay in your account while we work with you to address this issue.

You can see your balance and settlement information in the Payments section of Seller Central. If you have questions about those, please write to payments-funds@amazon.com.

To sell on Amazon again, please send the following information to pq-review@amazon.com:

-- Copies of invoices, receipts, contracts, delivery orders, or authorization letters from your supplier issued in the last 90 days. The quantity of items shown should match your inventory.

-- If you are not the brand owner, provide an authorization letter and a complete set of documentation, including authorization letters, to prove a valid supply chain.

-- If you are the brand owner, provide a copy of the brand registration certificate, and business license or personal identity card.

-- Contact information for your supplier, including name, phone number, address, email, and website.

You can send .pdf, .jpg, .png, or .gif files. These documents must be authentic and unaltered. You may remove pricing information, but the rest of the document must be visible. We will maintain the confidentiality of your supplier contact information.

In addition, send us a plan with actions you took to resolve the issue and prevent similar complaints. Do not limit your plan to issues with specific orders.

We will review your information and decide if you may sell on Amazon again. If you do not send the required information within 17 days, we may not allow you to sell on Amazon. Failure to appeal this decision may result in us permanently withholding any payments to you and any FBA inventory of the items that caused “inauthentic” complaints may be destroyed at your expense.

参考了网上的前辈说的,马上写了申诉过去:

Dear Amazon seller support:

Thank you for your concern of our account. We received a notification today that our selling privilege has been removed cause we infringe intellectual property rights. 

We are very sorry and apologized that we have infringed intellectual property rights, because we are the new seller, just  Launched, lacking of the rules and policies. We don't know the brand name " xxx" has the intellectual property rights, we haven't heard "xxxxx", it is not allowed in China, we know it from Amazon, and we have no idea it is a Brand. Now we are really sorry for our mistake.

We would do our best for the request from Amazon. 

1. We immediately check all our list and remove the list involved the property rights, including, please check the image-list removed

2. Attached the documents from our supplier, we promise we don't mean to infringe intellectual property rights, we just wanna purchase the high quality product for consumers and do our contribution to Amazon.

3. The products are the good quality and great, there's no any brand name " xxxxx " words on the product the packaging, we don't use any brand name on the products. And we will not sell them any more. 

We would do the following plan to creat a good account and obey all the rules on Amazon.

1. We absolutely will not list any products named " xxxxx " or similar products.

2. We will not purchase from this supplier anymore ONLY from the Original brand owner.

3. We will train all our staffs to learn the Amazon Rules, make them know what should do and what should not do, we will 100% obey Amazon rules and cooperate the request.

4. We are a good wholesaler on Alibaba.com, website xxxxxx , we also have our own another Brand products which named , attach the brand for your reference. We have a good business wholesale, and we learn amazon is the good and popular Retail business in USA, we would plan to list our own brand products, the high quality and best price in USA. 

We could sell about 300pcs items, 3000-4000USD sales data in a month, and also ship with FBA, which will be faster and better for consumers.

5. We will offer the best service to USA consumers, including good product with best price, warranty, help consumers to solve any problem.

We sincerely apologize for this  property rights issue, and we will not make it again, we will do the request and obey the rules from Amazon in the future.

Hope you can consider and give us a chance, we promise we could be a good seller on the Amazon.

Hello,

We reviewed your account, and we have decided that you may no longer sell on Amazon.com. Your listings have been removed from our site and we are withholding any funds available in your account. If you have FBA inventory of the items causing “inauthentic” complaints, they are currently ineligible for removal.

If you do not appeal this decision in 90 days, we will permanently withhold any payments to you, and any FBA inventory of the items that caused “inauthentic” complaints will be destroyed at your expense.

You can see your balance and settlement information in the Payments section of Seller Central. If you have questions about those, please write to payments-funds@amazon.com

If you want to appeal this decision, click the Appeal button next to this message on the Performance Notifications page in Seller Central (https://sellercentral.amazon.com/gp/customer-experience/perf-notifications.html).

The sale of counterfeit products on Amazon is strictly prohibited. If you cannot provide valid invoices or receipts for the items that caused “inauthentic” complaints, funds will be withheld equivalent to the amount you earned from the sale of these items in the last 180 days. If the equivalent amount is greater than the total amount available in your account, then the total amount will be held.

然后我补了一封详细的申诉过去:

Dear sir,

Thank you for your reply email.

We need to appeal this decision, please refer to the following points.

We sincerely apologize:

1. We didn't deeply learn the Amazon policy, so there's the mistake happened.

2. As soon as we received the email from Amazon, we took it seriously that we checked all our account list and immediately removed them.

3. We had already broke with the suppliers, no more work with them, no more sell these items.

3. There's no any complaint or bad feedback from our consumers, we always devoted to offer good service and satisfy consumers. 

4. The involved list is not a " inauthentic " complaint from our consumers, it is a mistake by our new staff Pauline typed the wrong name while created listings, she's no idea what brand "xxxx" means, she is too young and didn't know anything outside the world, she just has a dream, offering more good products and good service on Amazon. Please give a chance.

If we could have the chance to sell again on Amazon, we have a detail plan to do the best.

1. We would set a rule according to the Amazon policy, have all our staffs learn the Amazon policy and obey it.

2. We will have a team to double check the inventory and the selling list, would make everything correct, no trouble Amazon sending the email.

3.We will be more and more careful and check the new creating list, we are learning the foreign brand from many channel, such as http://www.sellerdefense.com/index.php/史上最全GBC品牌列表 and http://www.markhound.com/ . So that we would not make it again, please do believe us.

4. Now our company is very care about this problem, we have set up a department for Amazon account, 2 persons check up all the suppliers, make sure they are the manufactory and the brand owner, otherwise no cooperation; 3 persons doubel check up all the new listing, including the title, brand name, good price, product description, image, sales discount and also the product directions. 5 persons take care of the consumers questions and any inquiry within 12 hours, due to the time difference. 

5. Although we are the new account, our company is doing the good wholesale business on Alibaba with the good reputation from our customers, attached the good feedback from our customers.

We have made a plan if we could sell on Amazon. We are the manufacory having our own brand, high quality with good price. We plan to have 30 list sending to FBA within a month, about 3000 - 5000USD with a month, 60 list added in the next month, sales could be 10000 - 20000USD, there would be about 100 list by FBA. We know FBA is the BEST way, we really like it and think it good. It is very popular in China.

Please do consider our appeal, we would make the good account with FBA, no more make a mistake, no more trouble. We will fight for 5 stars and offer good service to consumers.

Hope Amazon team could give us a chance, we will be very appreciate.

我在网上看过很多的申诉,基本都是这样子写的,我也写了很详细的未来销售计划,还有的人甚至申诉的时候说到亚马逊没有十足的证明这是个侵权,他们也申诉成功了。这是得看运气么?

请教各路大神,我现在是要怎么做才能把帐号要回来?可以继续申诉吗?申诉应该怎么写才好?
